FashionViral is operated by Fashionviral Ltd, Al Sufouh 2, Al Sufouh, Dubai, United Arab Emirates ("FashionViral", "we", "us" or "our"). These terms of use (the "terms") apply to fashionviral.net, to the place pages and listing pages published on its subdomains and to its forms (together, the "website"). Our privacy policy explains how we handle personal data and forms part of these terms.

By using the website, you agree to these terms. If you do not agree, please do not use the website. If you use the website on behalf of a business, you confirm that you are authorised to accept these terms for it.

Definitions

• "Place" means a mall, outlet, souq, store or other shopping destination described on the website.
• "Listed business" means the owner or operator of a place.
• "Content" means the texts, photos, data, ratings, summaries, lists, design and other material on the website.
• "Submission" means any information you send us, through a form, by email or otherwise.

What FashionViral provides

FashionViral is an information guide that helps you discover shopping places, compare them and plan visits. We do not sell products, take orders, make reservations or handle payments, and we are not an agent of any listed business.

Any purchase, booking or other dealing you have with a listed business is between you and that business. Its own terms, prices, returns and warranty policies apply, and we are not responsible for its goods, services, staff, premises or conduct. If you have a complaint about a purchase, please contact the business directly.

Who may use the website

The website is intended for a general audience. You may use it for your personal, non-commercial shopping research, and businesses may use it to check and improve their own listing. If you are under the age of majority where you live, please use the website with the involvement of a parent or guardian.

Accuracy of information

We work hard to keep the guide accurate and up to date, but much of the information we publish comes from public sources and changes often. Opening hours, the stores inside a mall, brands carried, prices, promotions, parking and accessibility can change without notice, especially during public holidays, Ramadan and sale seasons.

Content is provided for general information only. Please confirm anything important, such as whether a store is open or stocks a product, with the business before you travel or make a decision. We are not responsible for any loss caused by information that turns out to be out of date or incomplete.

Ratings, reviews and editorial content

Ratings, scores, review extracts and summaries of what visitors like and dislike are based on reviews from shoppers across multiple apps and platforms, together with our editorial judgement. They are opinions, not statements of fact or guarantees of quality, and they may not reflect your own experience.

Our editor's picks, rankings and descriptions are chosen independently. Businesses cannot pay to be included in them, to change a rating or to have a review summary edited or removed.

Business listings and submissions

Any business that meets our listing criteria can ask to be added through the Add Your Business form, and any listed business can ask for a correction. When you send us a submission, you confirm that:

• the information is accurate, up to date and not misleading;
• you are entitled to share it, including any photos or logos, and it does not infringe anyone's rights;
• you are the business owner or are authorised by the owner, if you ask for a change to a listing.

You grant us a worldwide, royalty-free, non-exclusive and perpetual licence to use, edit, adapt, translate and publish your submission in the guide and in our apps. We decide which places are listed and how they are presented. We may decline a request, edit a listing or remove it at any time, for example if a place closes, no longer meets our criteria or appears to be misleading. Being listed does not create any partnership, agency or endorsement.

Acceptable use

You agree to use the website lawfully and in a way that does not harm us, other users or listed businesses. In particular, you must not:

• copy, scrape, crawl or republish substantial parts of the website by automated means, or use the content to build a competing directory or dataset, without our written permission;
• try to gain unauthorised access to the website, its servers or its data, or interfere with its security or performance;
• send spam, malicious code or automated submissions through our forms;
• submit false, misleading, defamatory or unlawful information, or impersonate another person or business;
• remove or alter any copyright, trademark or other notices on the content.

Search engines and similar services may index the website in line with our robots.txt file.

Intellectual property

The website's design, texts, summaries, compilations, selection and arrangement of places, and the FashionViral name and logo, belong to Fashionviral Ltd or its licensors and are protected by intellectual property laws. Photos, trademarks, logos and reviews of third parties belong to their respective owners and are shown to identify and describe the places concerned.

You may view the website, share links to its pages and print or save individual pages for your own personal, non-commercial use. Any other use requires our prior written permission.

Copyright and content complaints

We respect the rights of others. If you believe that content on the website infringes your copyright or other rights, or that a photo or description of your business should be removed, write to [email protected] with:

• the page and the content concerned;
• a description of your rights and why the content infringes them;
• your name and contact details, and a statement that the information in your request is accurate.

We will review every complete request and remove or correct content where appropriate.

Third-party content, links and services

The website includes content and services provided by third parties, such as Google Maps, ratings and reviews from other platforms, and links to businesses' own websites, social media and apps. We do not control these third parties and are not responsible for their content, availability, accuracy or privacy practices. Your use of them is subject to their own terms.

Advertising

The website is free to use and is supported by advertising, including ads served by Google. Ads are labelled or clearly separated from our editorial content. An advertisement does not mean that we endorse the product, service or business advertised, and advertisers have no influence on our listings, rankings or descriptions.

Availability and changes to the website

We aim to keep the website available at all times, but we do not guarantee that it will be uninterrupted, secure or free of errors. We may change, suspend or stop any part of the website, add or remove places, cities or countries, or limit access to it, at any time and without notice.

Disclaimer

To the extent permitted by law, the website and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of accuracy, completeness, fitness for a particular purpose and non-infringement.

Limitation of liability

To the extent permitted by law, we are not liable for any indirect or consequential loss, loss of profit, loss of data or loss of opportunity, or for any loss arising from your dealings with a listed business, from your reliance on information on the website or from the website being unavailable. Our total liability to you in connection with the website is limited to AED 100.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited or excluded under applicable law, and nothing in them affects your statutory rights as a consumer.

Indemnity

If you use the website in breach of these terms or the law, or send us a submission that infringes someone else's rights, you agree to compensate us for the reasonable losses, costs and claims that result from it, to the extent permitted by law.

Suspension and termination

We may block or restrict access to the website, or refuse submissions from you, if we reasonably believe that you have breached these terms or the law. The sections on intellectual property, submissions, disclaimers, liability and governing law continue to apply after your use of the website ends.

Changes to these terms

We may update these terms from time to time, for example when we add features, cover new countries or when the law changes. The date at the top of this page shows the latest version. Changes apply from the date they are published, and continued use of the website means you accept them.

General

• If any part of these terms is found to be invalid, the rest remains in force.
• If we do not enforce a right straight away, we can still enforce it later.
• You may not transfer your rights under these terms; we may transfer ours to a successor business.
• These terms and the privacy policy are the entire agreement between you and us about the website.
• These terms are written in English. If they are translated, the English version prevails.

Governing law and disputes

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, and the courts of Dubai have jurisdiction over any dispute arising from them or from your use of the website. If you are a consumer living in another country, you also keep any mandatory protection given by the law of your country of residence, including the right to bring a claim in your local courts. Before starting any formal proceedings, please contact us so we can try to resolve the issue informally.
